Man Injured in Officer-Involved Shooting in Miami-Dade County. What to Know.

A Miami detective shot a man at an apartment complex in West Miami-Dade County Wednesday night while conducting a “proactive detail” with a multi-agency task force, according to reporting from the Miami Herald.

The incident happened around 10 p.m. at 9599 Fontainebleau Blvd. Neither the man nor the detective, who investigates robberies, have been named as of Thursday.

The man is expected to be OK, a Miami Police Department spokesperson told the newspaper. The detective was not injured in the shooting.

The incident is being investigated by the Florida Department of Law Enforcement.

As the sale of firearms increases, so does the possibility of these types of injuries. On average there are about 500 to 600 deaths each year in the U.S. from accidental shootings, according to data from the Centers for Disease Control. These incidents also account for an average of 1,500 to 2,000 injuries annually. These unintentional incidents can happen in domestic settings, during recreational activities or when children get ahold of a family member’s firearm that has not been properly locked away. Negligent Security Cases Handled by Leesfield & Partners

Bernardo Pimentel II, a Trial Lawyer, at the firm, is currently litigating a case in which two police officers on off-duty detail responded to a shooting at a nightclub in Doral.

The shooter in that case was able to slip past security’s notice, bringing a weapon inside the club with him. When he got into an argument with another patron, he began shooting. Seven people, including one of the officers represented by Leesfield & Partners were injured. A 23-year-old security guard at the bar and the shooter both died.

The bar lacked properly trained security that should have checked all patrons for weapons before allowing them to enter the premises. A guard who had not undergone adequate safety training was on duty the night of the shooting.

In addition to our client’s physical injuries, both officers have suffered from post-traumatic stress disorder.

Had security checked patrons for weapons before granting them entry, this incident would not have taken place, according to Mr. Pimentel.

“It is our opinion that the tragic events of that evening were not only preventable but highlight a significant lapse in ensuring the safety of both the bar’s patrons and responding officers,” he said. “Had appropriate security measures been in place, the lives of those present, including Officer Romo and Officer Acevedo, would not have been put in such peril.”

That case is ongoing.

In a previous negligent security case that resulted in the violent rape of a woman and the beating of her and her husband at the hands of a crazed attacker, Leesfield & Partners obtained a $16 million settlement. That case was handled by Partner Justin B. Shapiro.

The incident happened at a hotel where the couple was staying. The property had a history of gun violence and crime. Officials with the hotel were advised by a security company and police to hire armed security guards. This advice was ignored. On the day of the attack, there were no elevator access control systems in place to stop the man, who was not a guest, from using the elevator to get to any floor in the hotel. Additionally, neither employees nor security stopped him from using the elevator and going up to our client’s hotel room where he began a violent assault on the husband before turning on the wife who he beat, raped and sexually assaulted.

Both employees and hotel security witnessed the vile attack but did nothing to stop it.

The firm obtained $15 million settlement in a case involving a deadly apartment complex shooting.

The firm also obtained a $1 million recovery for a 26-year-old client who was assaulted at a Monroe County bar.
